What are my options to resolve a family dispute?

We understand that Family relationships can be difficult.  Emotions are high and communication can become almost impossible.  Scammell & Co provides assistance to parties who wish to resolve family law issues about parenting, property and financial matters.  We aim to assist with dispute resolution to help people affected by separation. 

The law requires separated parties to make a genuine effort to resolve their dispute before filing proceedings in Court.  We can assist you to communicate and negotiate a settlement and to attend with you at a lawyer assisted mediation.  We work with you to manage the stressful periods and to get you through the processes required to finalise your dispute.

In a parenting matter , it is important that the parties can learn how to co-parent effectively to avoid potential harm to the children. 

If the parties cannot come to an agreement, the dispute may need to be resolved through litigation, which is a legal process where both parties present their case to a judge.  This may take some months (if not longer) to resolve matters with the parties obliged to continue to negotiate.  If the parties cannot reach agreement the matter may be referred to trial where a Judge will make a decision based on the evidence and arguments presented.
