Have South Australia’s new inheritance laws impacted your will?

The Succession Act 2023 came into effect on 1 January 2025 and represented the biggest change to South Australia’s inheritance laws in over 50 years.

This new legislation gave certain classes of people the right to inspect a deceased person’s will before a Grant of Probate is made. These include beneficiaries, former spouses, children, and anyone who has a legitimate interest in the estate.

The Act also changed the rules regarding inheritance claims as the deceased person’s wishes are now the primary consideration in family provision claims.

Other changes include different rules for administering estates and the roles of executors and administrators have now been clarified.
