What Is an Intervention Order?

An intervention order (IVO) is a legal mechanism put in place to protect those who have experienced family violence. It's important to note that a personal intervention order can also apply to cases involving co-workers, neighbours or any non-domestic relationship. Let's look at some of the common things you might ask about intervention orders. 

Are IVOs and AVOs the same thing?

There are very slight differences between an intervention order (IVO) and an apprehended violence order (AVO). Although they typically serve the same function, each state and territory in Australia uses different terminology. You may also have heard the term 'restraining order', which is much the same as an IVO or AVO. 

In South Australia, for example, IVOs are issued for both domestic and non-domestic issues, while in NSW, they use an Apprehended Domestic Violence Order (ADVO) and Apprehended Personal Violence Order (APVO) separately. 

The Purpose of an Intervention Order

Intervention orders protect sufferers of domestic violence, personal violence, harassment and intimidation. The person placed under the order may not contact or communicate with the other party in any way or face legal ramifications such as a breach of IVO offence. 

All cases are viewed differently depending on individual circumstances. As such, an IVO may have specific terms, for example, that contact between separated parents only be regarding a child's welfare. 

How to Take Out an Intervention Order

If you have concerns for your safety and another person is responsible, you may apply to the courts for an intervention order. The best way to approach this is with legal representation. A lawyer can start by giving preliminary advice, such as the likelihood of your application's success. They can also represent you in court when applying for the order. While you can do this yourself, a lawyer is more familiar with the relevant laws and regulations, giving you a greater chance of success.
